How Can You Stay in Australia in the Later Stages of a Subclass 462 Visa? A Detailed Look at the Lesser-Known DAMA Migration Pathway

Key points

What must an employer do for a Subclass 462 holder to apply through DAMA?

The employer must be located in a DAMA area and conduct labour market testing to demonstrate genuine recruitment difficulties. They must also cooperate with the process from RDA endorsement through to an agreement with the Department of Home Affairs. Securing employer cooperation is a key challenge.

  • Standard employer sponsorship usually requires an occupation at ANZSCO Skill Level 1–3, while DAMA can cover Skill Level 4–5 occupations.

Some readers have asked whether DAMA might be an option. Today, I will discuss it through two recent cases.

Designated Area Migration Agreements (DAMAs) are special employer-sponsored pathways for designated regional areas in Australia. Compared with standard employer sponsorship, they cover a broader range of occupations and offer corresponding concessions on English, work experience and salary requirements.

The Viability of a WHV-to-DAMA Migration Pathway Through Real Cases

First, let’s look at two recent cases that received nominations.

Key Advantages of Australia’s DAMA Pathway for Working Holiday Visa Holders

These two successful cases show several core DAMA advantages.

Extremely broad occupation coverage: Standard employer sponsorship usually requires an occupation at ANZSCO Skill Level 1–3, but DAMA can cover Skill Levels 4–5. This includes aged care; hospitality roles such as waiters, bar supervisors and kitchen assistants; logistics and retail roles such as storepersons and retail supervisors; agricultural roles such as fruit growers, aquaculture workers and meat processing workers; and construction-related positions. This greatly assists many occupations that cannot use traditional skilled migration or standard employer sponsorship.

Lower thresholds: A standard Subclass 482 visa usually requires 2 years of full-time work experience, whereas DAMA requires only 1–1.5 years of relevant work experience for Skill Level 4 occupations, such as the Storeperson in the case, and even allows qualifications and work experience to be substituted for each other.

English, salary and age concessions: English requirements are substantially lower, with lower-skilled occupations usually requiring only an overall score of 4.5–5, and individual bands as low as 4.

Salary thresholds allow a concession of up to 10%.

Under a DAMA, the age limit for Skill Level 1–4 occupations can be raised to 50 or even 55.

DAMA Challenges and Application Timeframes

The overall DAMA pathway is shown in image 4.

Australia currently has 13 DAMA programmes (image 5). You must first confirm whether the target employer’s region is covered by one of the 13 DAMAs.

So where are the challenges with DAMA?

The main difficulty lies with the employer. The employer must conduct labour market testing and demonstrate genuine recruitment difficulties. In addition, from RDA endorsement through to signing an agreement with the Department of Home Affairs, the entire process generally takes more than 10 months, demanding a very high level of employer cooperation.

Policy Risks for WHV Holders Applying Through DAMA

Migration policy is currently in a period of reform, and Working Holiday visas have been among the first to face various restrictions and adjustments. Future onshore applications for a second or third Working Holiday visa may also face changes.

For Subclass 462 holders, or people in Australia working in lower-skilled or regional roles or with hands-on skills, DAMA may be worth trying if you already work in hospitality, warehousing, retail, agriculture or another regional occupation. Although the overall assessment period is long, once the application reaches the processing stage, you can obtain a bridging visa and remain and work lawfully in Australia. For many Subclass 462 holders and lower-skilled workers, this is a practical pathway with an extremely low threshold and a clear route!

Questions and answers

What work experience does DAMA require for Skill Level 4 occupations?

For Skill Level 4 occupations such as Storeperson, DAMA requires only 1–1.5 years of relevant work experience and can allow qualifications and work experience alone to substitute for one another.
