Benefits for onshore and offshore workers! 200+ new occupations with a direct PR pathway! Older applicants, weaker English, non-traditional migration fields — a chance at a green card in just 2 years!

The upcoming 2023-2024 financial year is set to be agolden moment for working people. To address Australia’s long-term skills shortage in the labour market, Australia has fully opened up the employer-sponsored pathway to permanent residency, waiving many of the special requirements and restrictions on employer sponsorship — a particularly favourable development for employer-sponsored applicants.

Under the new policy, the migration pathway for the TSS Temporary Skill Shortage visa (482)is now very clear: once you hold this visa, you can obtain permanent residency in as little as 2 years.Today we will go through some of the advantages of the 482, its basic requirements, costs, and the requirements and benefits that come once you hold a 482 visa.

482/Visa advantages

No

age limit

For many applicants, age is a major factor in migration. For skilled-migration applicants, age is an important factor in the points calculation and is particularly unfavourable for older applicants — those over 40 lose 15 points outright. The 482 visa, however, has no such issue;whether you are 20, 30, 40 or 50+, you can apply for the 482 visa, but note that there is an age limit when transitioning to permanent residency (some occupations can be exempted from the age limit).

Applicants hoping to move from a 482 visa to permanent residency should still plan ahead.

No need for

skills assessment

Whether it is skilled migration or employer sponsorship that grants PR in one step, a skills assessment is unavoidable. A skills assessment is an evaluation of the applicant’s qualifications and work experience carried out by an assessing authority designated by the Department of Home Affairs, to determine whether the applicant can use that occupation as the nominated occupation for a visa application.

However, many applicants get stuck at this step. Some applicants, because their qualifications are unrelated, have years of work experience deducted, which lowers their migration points. And because some assessing authorities hold a monopoly, lengthy processing delays have caused applicants to miss many migration opportunities.

The 482 visa is different: most occupations — such as management, engineering and IT — do not require a skills assessment.Only a small number of trade occupations require a skills assessment, which greatly simplifies the application process and waiting time, and saves the applicant as much cost and effort as possible.

All can

move to PR

Previously, employer sponsorship only made you eligible for permanent residency if your occupation was on the long-term list, and you could only transition to PR after 3 years. Many common occupations — such as marketing specialists, finance professionals, events planners and arts professionals — faced restrictions on moving to PR even while holding a 482 visa.

But the government has announced that by the end of this year, more than 200 additional occupations will be able to transition to permanent residency, and all short-list occupations will be eligible. As a result, the occupations that can move to permanent residency through employer sponsorship now cover almost all of the jobs that working people do, and the timeframe has been shortened to 2 years.

No

quota limit

The more familiar Subclass 189, 190 and 491 state-nominated visas have a grant quota each financial year, and the 190 and 491 are first subject to state-nomination invitation quotas. Although the Budget has announced that the new financial year’s grant quota remains stable at 190,000, and the allocation of grants to the 189, 190 and 491 is quite substantial, there is always a quota limit in place, which means that in the final months of each financial year, insufficient quota leads to no new invitations being issued or slow processing. For example, NSW 190 nominations sold out by the end of April and no further quota could be released. Likewise, grants for the 189, 190 and 491 slowed across the board entering May, because little of this financial year’s quota remained.

The 482 has no quota limit on grants in any financial year — applications can be lodged and processed normally throughout the year. This financial year, the entire 482 process has maintained a processing time of 3-6 months, and entering 2023 many have been faster than 3 months.

English

no four 6s required

English requirements that redefine your expectations

Four 6s, four 7s or even four 8s in English have become essential application requirements for most skilled-migration applicants. But for the 482 visa, you do not need to reach any of these — an IELTS score of 5 or PTE 36 is enough to apply.

Whole family

migration

Employer sponsorship also lets one applicant migrate with the whole family.Employer sponsorship offers more places than any other visa category: the primary applicant’s spouse and children can all come to Australia to work and study together, and the whole family obtains permanent residency together.

Requirements for the 482 visa

– Sponsorship provided by an approved employer

– The applicant’s occupation is on the corresponding Department of Home Affairs occupation list

– The applicant has at least 2 years of full-time work experience highly relevant to the nominated occupation

– The salary offered by the sponsoring employer is no lower than the market standard

– Meeting the English requirement, with a minimum of IELTS overall 5 and 4.5 in each band (PTE 36/30)

and so on

Application process for the 482 visa

Application process for the 482 visa

A 482 application involves 3 steps: Sponsorship + Nomination + Visa

Sponsorship that is, the employer’s sponsorship eligibility. At this step the Department of Home Affairs assesses the employer’s operations, size, office location, revenue and so on to decide whether the employer is eligible to sponsor.

Nomination is the most important part — the employer proves to the Department of Home Affairs why it needs to hire this person, why the nominee matches the position the employer requires, how the salary offered was determined, and so on.

Visathe application mainly verifies the applicant’s personal background, character, health and work experience.

482 visa Q&A

01

Can I work multiple jobs after I get the visa?

Many people ask whether, after getting the visa, in addition to working for the employer who sponsors them, they can take on extra work to earn more money. The answer is no.The 482 visa has strict conditions stating that you may only work in the nominated occupation for the nominating employer. So if you want to drive for DiDi or Uber after work, that is also not allowed. However, if you have to end your employment due to factors beyond your control, there are additional solutions available.

02

Do children get any schooling concessions after getting the visa?

The school fees for the children of 482 visa holders in Australia are the same as those for international students; this depends on the regulations of the education department of the state in which you work. The table below will help you better understand the school fees for the children of 482 holders in each state.

Employer sponsorship requires no points test, no skills assessment for most occupations, and has very low language requirements;
the focus of assessment lies inthe applicant’s work experience, the employer’s eligibility, and the genuineness and reasonableness of the nominated position, and so on.
