Department of Home Affairs is Actively Auditing Applicants’ Past Australian Study Records — Essential Notes for Anyone Renewing an Australian Visa!



From time to time, students ask us:If I hold an Australian Student visa but do not attend classes, is that allowed? Will the Department of Home Affairs really notice?

Students have all sorts of reasons for not attending, such ashealth issues or gaps between courses

From a legal standpoint, if you hold a Student visa in Australia for an extended period without actually studying, you breach Condition 8202 and your visa can be cancelled.

From a practical standpoint, the Department of Home Affairs has cancelled a large number of Student visas in recent times, and one of the leading reasons has been a breach of Condition 8202.

Quoting the Department of Home Affairs report released in October:

over the past three years, the number of visas cancelled for document fraud or breach of visa conditions has risen sharplyStudent Visa Cancellation Section, a dedicated unit that investigates non-compliance and unlawful conduct by Student visa holders.

Even for Student visas from many years ago, when you lodge a new visa application the Department will check whether you truthfully declared any breaches. If you do not declare accurately, they may invoke Public Interest Criterion 4020 to refuse the application, which effectively bars you from most Australian visas for three years!

Condition 8202 and what to watch for at your next visa renewal!


Let us start with the three core requirements of Condition 8202:

1. While holding a Student visa, you must remain enrolled in a valid CRICOS-registered course at all times.

As a general rule, you cannot go more than two months without a Confirmation of Enrolment (CoE). The Department of Home Affairs can see every CoE you have held — whether they run continuously, whether any ended early, whether you withdrew, and so on.

Many students only focus on their Student visa expiry date and overlook the dates on their CoE. If you adjust your study plan during the course and this extends your studies, you must have a clear picture of your current CoE status.


2. You cannot downgrade your course level. If you move to a lower AQF level, you must apply for a new Student visa.

The only exception is moving from a PhD to a Master of Research — that particular downgrade is allowed without a new Student visa.

If you applied offshore for a higher-education course and plan to switch to a VET course after arriving, forget it — that loophole is not an option.


3. You must meet the course progress and attendance requirements.

For higher-education students, as long as you have enrolled and hold a CoE, you are generally presumed to meet the requirement. For VET, primary/secondary school, or English language (ELICOS) courses, if your attendance falls below 80%, the provider may report you, which places you in breach of Condition 8202. You may only be exempted if you have at least 70% attendance, satisfactory academic progress, or compelling and compassionate circumstances.


Once you leave Australia, the visa can be cancelled outright

We have also seen many cases recently where a student returns home, and while they are outside Australia their Student visa is cancelled directly. They only find out at the border on re-entry that their visa was cancelled for breaching visa conditions.

Because the holder is outside Australia, the Department of Home Affairs is permitted to cancel the visa directly without even issuing a Notice of Intention to Consider Cancellation (NOICC) — the visa holder is not given any opportunity to respond.


So if you have breached Condition 8202, take extra care when applying for your next visa!

You must declare everything truthfully.

If you do not declare accurately and the Department of Home Affairs later discovers it, it becomes far harder to explain the situation. Once your visa is refused under PIC 4020, a three-year bar attaches — and for those three years you will not be able to apply for most Australian visas.



Whatever the situation, never conceal the facts. Once you disclose them, you will need to attach a proper explanation and your GTE (Genuine Temporary Entrant) assessment will be reviewed more strictly, so additional preparation is essential. If you need help, please get in touch with us!
