No more waiting year after year for quotas to open, no points race, low English requirements, and fast processing for every occupation. It is time to take a closer look at this migration pathway.

News has emerged in recent days of sharp cuts to state-nomination quotas. The final figures are yet to be released, and Western Australia is leading a last push to defend its allocation, but plenty of people are already asking ahead of time:State nomination feels really tough this year. Are there any other options?

1. Lightning-fast processing
Subclass 482 is processed very quickly,within 3 monthsyou will receive a decision.

2. More occupations are about to gain a direct pathway to PR

3. The wait to move from Subclass 482 to PR is about to be cut by 1 year
the Department has confirmed thatfrom then on, 2 years of further work on a Subclass 482 will qualify you to apply for Subclass 186 PR, whereas the current requirement is 3 years.
Employer-sponsored migration falls into the Subclass 482 (TSS), Subclass 186 and Subclass 494 categories. Today we focus mainly onthe entry-level Subclass 482 (TSS)

The advantages of Subclass 482 (TSS) employer sponsorship


1、Subclass 482 has no quota cap
2. No competing against othersno points race, no need for a 7 or 8 across all English bands
3、Seamless year-round processing. Every occupation is now processed quickly, whether onshore or offshore, with no agonising wait for quotas or policy changes
4、Subclass 482 only requires IELTS 5. Only 2 years of work experience is needed, and for fields such as accounting, management, engineering and IT,most occupations require no skills assessment
5、there is no age limit when applying for a Subclass 482(an age limit does apply later when moving to PR)
6. With a single applicant,the whole family migratesand in several states, dependent children under 18 enjoy free or discounted compulsory schooling.
The Subclass 482 (TSS) visais a 2-4 year work visa under which the employee works full-time for the sponsoring employer. After 3 years of work you can move to permanent residency (this will soon change to just 2 years).

Subclass 482 eligibility requirements


***The parties to an application arethe sponsoring employerandthe applicant (employee)
– An eligible employer provides sponsorship
– The applicant’s occupation is on the relevant Department occupation list
– The applicant hasat least 2 years of full-time work experience closely related to the nominated occupation
– The sponsoring employer pays no less than the market salary rate
– The applicant meets the English requirement,no lower than IELTS overall 5 with a minimum of 4.5 in each band (PTE 36/30)


The Subclass 482 application process


Subclass 482 application steps:
Sponsorship – the employer obtains approved sponsor statusNomination – the applicant’s nomination is approved Visa – the applicant’s visa is granted

Sponsorship – approved sponsor status: which companies can provide sponsorship?
This establishes the employer’s sponsor status. At this stage the Department reviews the employer’s operations, size, office location, revenue and so on to decide whether the business qualifies as a sponsor.
There are only two basic requirements:the company is a lawful business registered in Australia with genuinebusiness activity. This step is lodged in the company’s name; once approved, the employer’s sponsor status is valid for 5 years.
The costs the employer must cover include sponsor accreditation, the nomination application, and the Skilling Australians Fund (training levy);the visa application charge may be paid by either the employer or the employee

Nomination – the applicant’s nomination is approved
This is the central step of employer sponsorship, and it can be summed up asthe employer demonstrating to the Department why it needs to employ the applicant, for exampleshowing that the position is genuinely needed, for exampleshowing that the applicant is a good match for the role the employer offers. If you are sponsoring an existing employee, the supporting documentation needs to be carefully prepared. If the role is newly created, the company must provide stronger evidence of the position’s genuineness and its financial capacity.
In addition,certain nominated positions carry specific requirements (CAVEATS). Take the most familiar example,Accountant: the sponsoring company must have at least 5 employees and turnover above 1 million, and the applicant’s duties must be those of an accountant, not a clerical worker, bookkeeper or accounting clerk.

Visa – the applicant’s visa is granted
This step focuses on assessing the applicant (employee) themselves, including partner-relationship evidence (if a partner is included), work experience, and whether health requirements are met.

How to move from a Subclass 482 to permanent residency


1. The employee must be under 45 years of age
2. Achieve IELTS 6 across all four bands, or an equivalent English score
3. Continue working for the employer for 3 years (this will change to 2 years), with the 3 years of work during the Subclass 482 maintained in the nominated position.

So in short, the Subclass 482 (TSS) works like this:you already have some work experience, you secure a job with an Australian employer who is willing to sponsor you, you keep working for that employer, and once you meet the requirements you move to permanent residency (PR).
