That said,every stepping stone has its limitations and relative drawbacks.For instance, recent changes have made things less friendly for older applicants, and some may worry that even without a mandatory English requirement, insufficient English would make it hard to complete their studies — and so on.

What Is the Subclass 400 Visa?

This is a Temporary Work (Short Stay Specialist) visa.


Holders of this visa can use it to:

come to Australia for short-termhighly specialised work;

or to attend at the invitation of an Australian organisationcultural or social activities


Depending on the purpose of the visit, applicants must be able to demonstrate that the work or activities undertaken in Australia areinvited or supported by a local business or organisation.


When assessing this type of visa, the Department of Home Affairs places considerable weight on whether the applicant’sskills are scarce or unavailable within the existing local workforce.


The Subclass 400 visa allows holders to enter Australia on either a single or multiple-entry basis, depending on what the visa grants.

When applying,applicants may include their spouse and children.


Additionally, applicants must not be in Australia at the time of applying —that is, this visa must be applied for from outside Australia.There are also other conditions and criteria that must be met to complete the visa process,so it is advisable to consult with a qualified migration agent or consultant before submitting your final documents.


What Can You Do in Australia on a Subclass 400 Visa?

This visa allows holders to undertake temporary work or participate in temporary activities in Australia.Evidence required includes demonstrating that the applicant possesses skills and knowledge that benefit Australia, or the ability to support certain activities(however, applicants may not participate in any entertainment industry production intended for broadcast in Australia).


The Subclass 400 visa generally permits holders to work for up to three months at a time, with a maximum of six months if there are sufficient grounds.The visa may include eligible family members. Applicants must be genuine participants and may not engage in any study activities.


If, after working for 3 months (or up to a maximum of 6 months),youwish to remain in Australia, you may consider applying for another visa,though whether this is feasible will depend on the individual’s circumstances.


Who Can Apply for the Subclass 400 Visa?

You must be nominated by an approved Australian employer to work anywhere in Australia for up to 3 months (or up to 6 months in certain circumstances).


– Meet the skills/qualifications standard for Skill Level 1–3 occupations

– Have at least 2 years of work experience.

– Meet the English language requirements, with various tests and applicable standards

– Meet health and character requirements.

– A spouse and dependent children may be included in the application


Key Points to Note About the Subclass 400 Visa

The Subclass 400 visa is a temporary visa; holders may only enter Australia if they possess specific skills that are not available locally. There are many conditions for the Subclass 400 visa, and a valid application must comply with all of them. The key eligibility criteria for the Australian Subclass 400 visa can be summarised as follows:


Highly Specialised Skill Set

Applicants must possess highly specialised skills, knowledge, or experience that are in short supply in the Australian labour market. The work must contribute to Australia’s business environment and must be non-ongoing. Non-ongoing work refers to work expected to be completed within 6 months, and must not use this visa to arrange an extended stay.


Proof of Work

Applicants must provide proof of work. However, applicants may not participate in Australian entertainment industry productions intended to air in Australia. That said, a person may direct, perform in, or participate in film projects intended to screen outside Australia. However, this visa does permit any actor to attend a red carpet premiere; and any band to undertake a promotional tour, provided there is no live performance.


Dependent Family Members

Applicants must be able to financially support their dependants during their stay in Australia.


Health and Character Requirements

Applicants must meet the health and character conditions set by the Australian Department of Home Affairs. Applicants must also hold insurance approved by the Department.


Genuine Visitor

Applicants must intend to stay in Australia temporarily and comply with the conditions stated in the visa grant.


No Record of Visa Refusals

Applicants must not have had a visa refused or cancelled.


Processing Time and Permitted Stay

Permitted Length of Stay

Generally,the maximum permitted stay is three months,however, in limited circumstances, if there is strong business need to support it,a stay of up to six months may be considered.You cannot apply for this visa from within Australia, nor can you extend your stay by extending this visa.


Australian Subclass 400 Visa Processing Time

The processing time for the Subclass 400 visa will proceed within the usual timeframe permitted for applications. To achieve a smooth visa grant outcome, applicants are advised to lodge their application with the assistance of a capable and experienced Australian migration agent.
