Subclass 188A application requirements

Let us look at the Subclass 188A requirements so you can assess your own eligibility:
1) The main applicant must be under 55 years of age
2) Business Innovation points must total at least 65
3) A state or territory government invitation must be received after submitting an EOI through the Business Innovation and Investment Programme
4) Combined personal and spouse net assets must reach at least AUD 1,250,000
5) At least two years of business management experience within the past four years, with the business turning over at least AUD 750,000 per year (turnovers from two businesses may be combined)
6) There are also ownership-stake requirements for the business.

If the business turns over more than AUD 400,000 per year, the applicant must hold at least 30% of the business shares; if it turns over less than AUD 400,000 per year, the applicant must hold at least 51%. If the business is publicly listed, the applicant need only hold 10% of shares.

Additionally, the Subclass 188A has relatively relaxed audit requirements, with the focus on business turnover,and the main applicant can be changed after the Subclass 188A is granted.

The ability to change themain applicant”,is a benefit you should not underestimate!
This feature is especially favourable for parents in Australia on a Subclass 590 Guardian visa!

For example: after the Subclass 188A is granted, the main applicant is required to enter Australia. Because the main applicant can be changed after grant, if the other parent back in China cannot leave the business,the parent accompanying the child in Australia can take over and fulfil the subsequent residency and investment requirements for the Subclass 888 permanent visa.

This resolves the no-work-rights concern that many Subclass 590 holders have (the Subclass 590 does not include work rights)! After switching applicants, the Subclass 590 holder instantly becomes a Subclass 188A applicant — able to run a business, earn income, and work!

How does the Subclass 188 transition to permanent residency?

The Subclass 188 is a two-stage visa: you first obtain the Subclass 188 provisional visa, then meet certain requirements while holding it in order to transition to the Subclass 888 permanent visa.

Let us now look at the requirements for transitioning from the Subclass 188A to the Subclass 888!

What are the requirements to transition from Subclass 188A to Subclass 888?
1) The main applicant must have continuously managed a business for at least two years
2) In the two years before applying for the Subclass 888, the applicant must have held the Subclass 188 visa and lived in Australia for a cumulative total of at least one year.
3) The business ownership stake must still meet the relevant percentage requirements
4) In the 12 months before applying, the applicant, their spouse, or a jointly owned main business must have turned over at least AUD 300,000, and must meet at least two of the following three criteria:
– Continuously held Australian business net assets of at least AUD 200,000;
– Combined personal and business net assets of at least AUD 600,000;
– Employed at least two local full-time staff who are Australian citizens, Australian PRs, or New Zealand passport holders.

Overall, transitioning from a Subclass 590 Guardian visa to a Subclass 188A and then diligently running a business in Australia — earning income and migrating with the whole family — is absolutely within reach!
