From last week to today, have you been hit by wave after wave of news about the Subclass 189 and NSW Subclass 190?

Perhaps you arepleasantly surprisedbut not yet prepared?

Here are some common questions, answered all at once.

Regarding

189

I’ve already received an invitation, but some of my bonus-point documents have expired — can anything be done?

– (Primary/secondary applicant) Skills assessment expired: there may be a remedy

– NAATI expired: there may be a remedy

– CCL expired: there may be a remedy, provided there are available test spots

– Language test results expired (including for primary and secondary applicants): in most cases, this cannot be remedied


Can an expired skills assessment be renewed?

Most skills assessments are valid for 2–3 years and can be renewed or reapplied for once they expire.

We’ll walk through the specifics for different occupations tomorrow.


How long is a NAATI/CCL credential valid? Can it be renewed once it expires?

NAATI, and CCL credentials obtained before 9 August 2022, are valid for three years.

CCL credentials obtained on or after 9 August 2022 are valid for five years.

A NAATI credential that is still within its validity period can be renewed if a transition has been completed.

An expired CCL must be retaken.


How long is a PY valid? Can it be renewed?

The PY validity period is 4 years, counted from the date of commencement.

Completing the PY means completing all components of the entire programme.

The 12-month PY component must fall within the 48 months prior to receiving an invitation.

An expired PY cannot be renewed, nor can the programme be retaken.

Because one component of the PY is a work placement, universities generally require students to hold a visa that permits full-time work for at least 1 year (such as a Subclass 485).


Can I first submit an EOI to join the queue, and then apply for a skills assessment or accumulate points?

No.


How long are language test results (such as PTE or IELTS) valid — 2 years or 3 years?

The Department of Home Affairs accepts results that are up to 3 years old.


Can both onshore and overseas work experience count towards points at the same time?

Yes, but it must have been gained within the past 10 years and must be relevant to the nominated occupation on your skills assessment. Please contact Newstars for an assessment.


When is the next invitation round?
Unknown at this stage.
This financial year, invitations are being issued on an as-needed basis,not on a monthly or quarterly schedule.
Invitation rounds issued to date:
The round on 22 August 2022 issued 12,200 invitations — aside from a few top professions, invitations went to many offshore engineering and trades occupations, mostly at 65 points
The round on 6 October 2022 issued 11,714 invitations, with more engineering occupations invited
The round on 14 October 2022 has not yet been formally reported; high-scoring IT and accounting applicants received invitations, though in smaller numbers
The round on 8 December 2022 has not yet been formally reported — a historically rare flood of invitations189 Major Invitation Flood! Accounting at 85, Auditing at 75 — Huge numbers of IT/Engineering/Offshore applicants invited on low scores! Full breakdown of data!

Will there be another flood of 189 invitations?
The Subclass 189 does not have a specific quota for the number of invitations issued,only a quota for the number of 189 visas granted each financial year.
The latter underpins the former, but does not directly determine it.
If the Department of Home Affairs chooses to, it can issue as many 189 invitations as it likes —even if this financial year’s grant quota runs out, quotas from future financial years can be drawn upon.

Are there still specific quotas set for individual occupations?
There were previously; there are not any more.

Is it currently easier to be invited onshore or offshore for the Subclass 189?
Prior to this round, offshore applicants were clearly being invited at a higher rate (as shown in the official data), but this round has seen relatively more onshore invitations.

I am currently waiting for a state nomination invitation — can I also submit a Subclass 189 EOI?
Absolutely.

I currently hold a Subclass 887/489/482 visa — can I transition to a Subclass 189?
Yes, you can.

I’ve already received or lodged a Subclass 491 visa application — can I also try for a Subclass 189?
Yes, you can,provided the Subclass 491 has not yet been finally granted — you’re still able to try..
However, if the Subclass 491 has already been granted, you cannot apply for any other skilled visa for 3 years.
So if you have already lodged your Subclass 491 application — even if you’ve provided additional documents — and want to take advantage of this opportunity, please contact us as soon as possible to plan your next steps!

How long does it take to go from invitation to grant for a Subclass 189?
Visa processing is case by case. For high-demand occupations such as nursing, healthcare, and social work, most cases can be finalised within a few months. For other occupations — particularly given the large volume of new applications following this round — it is unclear whether processing times will slow down.

Will a Subclass 189 visa require a medical examination?
At present, all migration visas require a medical examination, regardless of whether the application is lodged onshore or offshore. Medical examinations are valid for 1 year; if you do not have a valid examination on file, you will be asked to undergo one.

NSW Subclass 190

How many NSW Subclass 190 allocation places remain?
The total allocation is 9,108 places. As of the data published on the Department of Home Affairs website at the end of November, 1,568 have been used. Including those who have received pre-invitations and are awaiting nomination processing,there should still be 7,000+ places remaining.

When will the next NSW Subclass 190 round be issued?
NSW also issues invitations on an irregular basis — historically mostly monthly, but recently invitations have been more frequent, and the dates are unpredictable.

Can I apply for both a Subclass 189 and the NSW Subclass 190 at the same time?
By lodging two separate EOIs.

I’ve previously received a NSW Subclass 491 nomination — can I try for NSW Subclass 190?
The NSW Government website states thateach person has only one opportunity to be nominated (nominated) by NSW,once a nomination is received, the opportunity to be nominated for any other skilled visa is forfeited — regardless of whether it is in the same financial year or whether the nomination has been used to lodge a visa application.
Of course, you can still try for a Subclass 190 nomination from another state.
By the same logic, if you have already received a Subclass 491 nomination from another state (provided it has not yet been granted), you can try for the NSW Subclass 190.

Does applying for the NSW Subclass 190 require that you currently be working in the nominated occupation?
Employment, or work in the nominated occupation, is no longer a prerequisite for the NSW Subclass 190. Having work experience in the nominated occupation may provide an advantage in receiving an invitation, though this is not explicitly stated.

Because employment is not a mandatory requirement, if you are based in NSW and working remotely for an employer in another state or overseas, this does not affect your ability to apply for the NSW Subclass 190.

I previously lived in NSW for several years but am now in another state — do I meet the residency requirement?
The NSW Subclass 190 requires applicants this financial year to:
– currently be residing in NSW
– and have been residing there continuously for at least 6 months

What are the requirements for lodging a NSW Subclass 190 application from offshore?
Applications can be lodged from offshore. Requirements are broadly the same as for onshore applicants: a skills assessment for the nominated occupation, a base score of at least 60 points, and a language score meeting four 6s,with a residency requirement of at least 6 months residing offshore.

Are NSW Subclass 190 visas processed quickly?
The Department of Home Affairs processes visas without distinction by state —there is no such thing as NSW Subclass 190 being processed faster or slower than Victoria’s Subclass 190.
Current Subclass 190 processing has progressed to approximately the first half of 2022,butnot having been granted by that point is also perfectly normal.
Whether it’s the Subclass 189, the NSW Subclass 190, or Victoria — which has the highest Subclass 190 allocation — regardless of whether you are currently onshore or offshore and want to start fresh,the single most important first step is to have a skills assessment,Without one, you cannot lodge an application through most of Australia’s skilled migration pathways. With the end-of-year holiday period approaching, processing will also see some delays.
