NSW State Nomination Opening Soon! Subclass 190/491 Requirements Updated — Major 491 Changes: Discouraging Interstate Applicants, Encouraging Regional Study!


The NSW state government has emailed to advise that state nominations for the new financial year will open shortly, and has outlined a number of changes to the Subclass 190 and 491 programmes. The specific occupation list has not yet been released — here is a brief summary of the key changes for this financial year.


NSW Subclass 190:



1. Applicants who have lodged an EOI with another state will not be considered

NSW will not consider applicants who have submitted an EOI with any other state or territory. All EOIs must be used solely for the NSW Subclass 190 application. This includes combined 189+190 EOIs — you must choose NSW Subclass 190 exclusively.


2. Residency requirements
NSW will only accept applicants who are residing in NSW or overseas. For onshore applicants, a minimum of six months’ residence in NSW is required; for offshore applicants, they must have been outside Australia for more than six months.



3. Requirements for offshore applicants
Offshore applicants are subject to the same requirements as onshore applicants. There will be no special pathway for offshore applicants this financial year.



4. Work experience and points requirements
Each nominated occupation will have its own minimum work experience and points requirements. Applicants must meet the minimum requirements to be eligible to apply.



NSW Subclass 491:



This financial year, the NSW Subclass 491 has2 application pathwayscompared to 3 last financial year:

Pathway 1:

Eligible applicants apply directly to the RDA office in the regional area where they intend to live and work for at least three years. As long as the applicant meets NSW’s minimum nomination requirements, they may apply directly to the relevant RDA until that region’s quota is exhausted.



Pathway 2:

Apply through Investment NSW. Applicants invited by Investment NSW may, after their visa is granted, live and work in any regional area of NSW for at least three years.



The major changes to the NSW Subclass 491 this financial year are:
1. EOIs must be lodged for NSW only — no other state or territory — and must be specifically for the 491.



2. Residency requirements
NSW will only accept applicants who are residing in NSW or overseas. For onshore applicants, a minimum of three months’ residence in NSW (including Sydney) is required; for offshore applicants, they must have been outside Australia for more than three months.


3. Offshore applicants
Offshore applicants are eligible to apply for any occupation that appears on the NSW state nomination occupation list and qualifies for the Subclass 491 visa. In other words, no occupations are excluded for offshore applicants this financial year.


4. Minimum work experience and points requirements
Each occupation on the list carries minimum work experience and points requirements. The specific minimums for each occupation will be determined by the quota available and the volume of EOIs received for that occupation.

5. NSW regional study — applicants who meet the conditions for study in a NSW regional area within 24 months of applying directly to an RDA may be exempt from the minimum work experience requirement, provided the applicant meets:
If the applicant completes study in a NSW regional area within 24 months of applying directly to an RDA, the minimum work experience requirement may be waived, provided the applicant meets:
  • The field of study is closely related to the nominated occupation
  • The study was completed in a NSW regional area that satisfies the conditions for the regional study points bonus


Newstars’ view on this:



Overall, there are no major differences between this financial year and the previous one. NSW has not yet received its quota allocation for the new financial year. The key thing to watch for remains the release of the occupation list, which will provide greater clarity on detailed requirements — particularly minimum work experience. On the surface, if each occupation carries a minimum work experience requirement, this could affect recent graduates or applicants who do not yet have work experience in their nominated occupation. The increase in the NSW residency requirement from three months to six months, along with the restriction that EOIs must be lodged for NSW only, appears to be intended to strengthen applicants’ commitment to NSW.


For the Subclass 491, the arrangement effectively restores a degree of nomination authority to individual RDAs. The RDA websites have not yet formally published their respective occupation lists and application requirements for the new financial year. So sit tight and wait for the opening.

Current status of state nominations across all states

NSW:The new financial year quota has not yet been announced. The occupation list and detailed application requirements will be published shortly. (Applications are not recommended prior to this financial year’s policy announcement.) No pre-invitations have been issued this financial year.


Victoria:Victoria announced last week that new financial year state nominations are open, with more occupations permitted and both onshore and offshore applicants eligible to apply. Canberra (ACT):The ACT government was the first to announce its transitional state nomination quota: 800 Subclass 190 places and 1,920 Subclass 491 places for the 2022–23 financial year, totalling 2,720.

QueenslandConfirmed receipt of transitional quota on 9 August. Applications expected to open shortly.The key policy direction for this financial year was announced at a recent information sessionbroadly: easing requirements for some local graduates, opening work pathways to offshore applicants (minimal changes for onshore applicants), and reopening the Subclass 188E investment stream.The application portal remains closed and will not open until the nomination quota has been received. South Australia:The occupation list and application requirements will be published shortly. The application portal remains closed. No pre-invitations have been issued this financial year.


Tasmania:On 11 August, Tasmania announced its 2022–23 transitional quota: 2,000 Subclass 190 places (up from 1,100 last financial year) and 1,350 Subclass 491 places (down from 2,200).


Western Australia:The occupation list and application requirements have been confirmed and published — great news for local graduates! The first round of pre-invitations has been issued, with accountants landing offers from a minimum of 80 points.
