All the news this week is about the major migration overhaul, so this issue of the Weekly is built around the reform. Beyond that, everyone is keen on grant and invitation progress, and this week is no exception.

Australia’s biggest migration system review since 1990 was recently handed to the Federal Government, examining every aspect of migration and offering recommendations. After reading the report, the Minister for Home Affairs gave a speech this Thursday outlining the broad changes the Government is currently looking to make.

Changes the Minister for Home Affairs mentioned and for which a timeframe can be roughly confirmed:
1. From 1 July 2023, the TSMIT threshold will rise from AUD 53,900 to AUD 70,000.
Who is affected:
This will definitely affect employer-sponsored TSS visa applicants.
It may also affect applicants transitioning from the 491 to the 191. It must be stressed here that the specific income requirement for the 491-to-191 transition has still not been clearly legislated; TSMIT and the 53,900 figure were first mentioned when the new 491 visa policy was introduced. We hope the Government clarifies the relevant legislation as soon as possible, and that it considers applicants who have already been granted the 491, at the very least offering a possible transitional policy.
Transitional policy:
The Minister for Home Affairs said there will be a transitional policy, but did not reveal the specific details.
However, because this higher threshold takes effect on 1 July, we expect plenty of detail to emerge in the near term.

2. Before the end of 2023, all temporary skilled migrants (this should mainly refer to employer-sponsored workers) will have a pathway to PR.
The preliminary plan is to establish three pathways
The first is a fast-track pathway for highly skilled, high-end professionals
The second will be the mainstream pathway, where eligible occupations adjust in line with skills demand over time
The third is for areas of critical shortage

Changes the Minister for Home Affairs mentioned that may be seen in the short to medium term:
1. The Minister for Home Affairs said the points table will be reformed, but gave no timeframe. She said the current requirements are set too low. Which skills and work experience the points system prioritises will depend on actual skills demand, rather than being based solely on the occupation lists.The review report, for its part, recommends adding points for partners in various circumstances.

2. The Minister for Home Affairs said the GTI will be reformed (the implication being that it should not be abolished entirely), hinting that there will be a new team to identify and seek out genuinely highly skilled global talent, to improve the clarity of the selection criteria. She also said the nominator requirement may no longer be needed going forward.

3. Business and investor migration will not necessarily be abolished, but there will be structural reform.They still need to understand more about the situation and gather more views from various quarters.

4. Scrutiny of the student visa system will be strengthened, with strict checks on the genuineness of students, and the student visa threshold will be raised (no timetable).

Migration review reformrecommendations the report raised, but that the Minister for Home Affairs did not mention — some of the key recommendations:
1. Introduce a ballot system for parent migration to prevent further backlogs.Roll out cheaper and more attractive temporary visas for parents. 2. Review the cap on student visa work hours, including whether unpaid work, integrated study, internships and work experience count towards the cap.

3. Have international students automatically receive a Graduate Work visa after completing study that fully meets the requirements

4. Align the English language requirement for student and/or postgraduate visas with that for skilled visas — that is, also requiring a 6 in each of the four bands

5. Replace the current GTE for student visa applications with a Genuine Student test (GST)

In short
For those that already have an implementation date, wait for the detailed rules
For everything else, lodge when you should — in most cases, the earlier you lodge, the more peace of mind
For example, if your EOI has already been invited, points-table reform will not affect you
If you’re on the 189/190 waiting for a grant, there’s no need to panic
If your PR has already been granted, still lodge parent migration sooner rather than later
