Home Affairs Tightens Subclass 600 Visitor Visas: Validity Cut to Six Months, With Condition 8503 on Large Numbers of Grants

Let’s talk about visitor visas today. We had wanted to hold off and see whether things would turn around, but with the grants that have come through over the past couple of days the pattern is now fairly clear, so let’s go through it in detail.

First, where things stood before this week:

1. Never been to Australia, no PR children: generally 1 year validity, stays of no more than 3 months at a time, and no condition 8503
2. Parents of a PR applying for the first time: 18 months validity, 12 months per stay
3. Parents of a PR who have been before, and have either not lodged parent migration or have lodged it but not yet received the QL: 3 years validity, 12 months per stay
4. Parents of a PR who have lodged parent migration and received the QL: 5 years validity, 12 months per stay

How the latest Subclass 600 visitor visa grant standards differ between applicant groups

From this week, large numbers of visitor visas have started to carry condition 8503, for parents of PRs and ordinary applicants alike (image 2)

Visa lengths are all over the place as well: ordinary grants have gone from 1 year validity to only 6 months, with 3 months permitted per stay,

and plenty of people who have lodged parent migration and been to Australia before are getting only 6 months validity with condition 8503. Previously these were 3- or 5-year visas with 12 months per stay

That said, today I still saw parents of a PR applying for the first time receive 18 months validity with 12 months per stay and no condition 8503. So far I have not seen any new 3-year or 5-year visas for parents of PRs

I have checked the Department’s internal PAM processing guidance, and the wording in Subclass 600 about permanent residents’ parents being able to stay 12 months at a time has not changed at all (image 3). But this is certainly not a one-off from individual case officers — taking together the cases we have in hand and the many cases online, this is a substantial shift in processing policy

What is Australia’s condition 8503, and what does it mean for applicants?

So what is condition 8503? Put simply, it means that once you enter the country you cannot extend the visa or switch to another visa. In fact, before COVID, 3-year visitor visas for parents of PRs generally carried 8503; during COVID it was removed because too many people were applying for waivers, and now it is partly back

The direct effect is that parents who want to spend long periods in Australia with their children have their stays cut short and have to lodge more often. If they want a long stay, the only option left is the expensive Subclass 870 sponsored parent visa, granted for 3 or 5 years

Why the Department is tightening Subclass 600 visitor visas and applying condition 8503

Why is the Department doing this? Combined with this financial year’s principle of prioritising onshore processing, it is probably to shut down the pathway of entering on a visitor visa and then switching to another visa onshore. Skilled migration is barely affected, but common family cases — such as entering on a Subclass 103 and switching to a Subclass 864, or entering on a visitor visa for partner migration and applying for a Subclass 820 — will be hit directly

Can 8503 be avoided? In practice, whether a grant carries 8503 does not seem to have much to do with the documents or the applicant’s circumstances. Applicants in a stronger position — people who have visited many times and have already lodged parent migration — have even been the ones given 8503. At this stage it looks fairly random

We will need to wait for further explanation from the Department. I will share more as soon as there is news!
