Want to visit Australia for tourism or to see family and friends? 3-6 months / 1 year / 3 years / 5 years… which Tourist visa is best for you? What to do if you are refused?



Lately we receive a steady stream of enquiries every day about Tourist and family-visit visas — from the parents of permanent residents, as well as from people who simply want to visit Australia for tourism, to see family or to catch up with friends. Today we will walk you through the Australian Tourist visa in detail.


1. One-year validity, maximum 3 months stay per entry

The most common and standard Tourist visa applied for from outside Australia

Applicable situations: This is the visa typically applied for by parents, siblings, relatives and friends coming to Australia for a short trip; also commonly used by the parents of TR holders (for example, Subclass 485/500/491/482 holders) who want to come to Australia to accompany their children

The most commonly misunderstood point:Many people assume that the 3-month stay must fall within the 1-year validity period — this is completely incorrect.For example, with the Tourist visa below, if you enter on 5 December 2020 you are able to stay until 5 March 2021 (not just until 10 December 2020).


2. Three-year validity, maximum 3 months stay per entry

Maximum 3 months stay per entry — a less common Tourist visa applied for from outside Australia

Applicable situations: same as above, however,This kind of visa can normally only be lodged through certain qualified travel agencies in China as the applicant’s agent. It is often referred to as a “business visa”,but in reality it is still a Tourist visa — the subclass code is still 600.


3. Three-year validity

Maximum 12 months stay per entry; no more than 12 months in total within any 18-month period

Applicable situations: The applicant must be the parent of an Australian PR or citizen, must have previously held a Tourist visa to Australia, and is required to take out health insurance and undergo a medical examination. Although this visa is often called a “family-visit visa”, it is still a Tourist visa. Once the child secures permanent residency, this is typically the type parents apply for.


4. 18-month validity

Maximum 12 months stay per entry; no more than 12 months in total within any 18-month period

Applicable situations: almost identical to category 3; the only difference is that,it is for parents of PR holders who have never been to Australia before. In practice, parents almost always come to Australia at least once first and only then decide to stay longer on their second trip, which is why nearly everyone applies for the 3-year visa;applications under this category are comparatively few.


5. Five-year validity

Maximum 12 months stay per entry; no more than 12 months in total within any 18-month period

Applicable situations: also almost identical to category 3; the only difference is that,PRthe parents must already have lodged a Subclass 103 or Subclass 143 Parent visa application and received a Queue letter.


6. One-year validity

Maximum 6 or 12 months stay per entry

Generally available to parents of PRs or citizens, and a medical examination is required. Applications in this category are relatively rare — it is usually more sensible to apply for category 3 in the first instance.


7. Ten-year validity

Maximum 3 months stay per entry; no more than 12 months in total within any 24-month period

Applicable situations are the same as category 1, but this visa carries a significantly higher application fee and also requires you to attend a visa application centre for facial and fingerprint biometrics. It is therefore best suited to affluent travellers or business people who would prefer to avoid the inconvenience of applying multiple times.


8. PR / citizen family sponsorship

A single-entry Tourist visa with a stay of anywhere from 1 to 12 months after entry

Aimed at applicants with a previous refusal, from a high-risk country, or with weaker financial circumstances, who havea citizen or PR family member in Australia willing to act as sponsor; this visa generally carries an 8503 “No Further Stay” condition.


9. Business Visitor stream 

Commonly used for coming to Australia for business inspections, contract negotiations, site visits, meetings and similar activities.

Not just“a friendly letter of invitation from a company”will do; the Australian company must issue the invitation and a supporting letter, and you must be able to provide sufficient


supporting documentation for the business visit, for examplewhy the trip is necessary — are you coming to deliver training? to attend meetings? to provide technical support? You also need todemonstrate the business relationship between the companies in China and Australia, the applicant’s own work-related dealings with the Australian company, and why this particular person needs to come to Australia.


10. Tour-group visa

Available only to certain qualified travel agencies in China for group bookings.This visa carries the 8503 condition and cannot be extended onshore.We will not go into further detail here.


Onshore Tourist visa

is fundamentally different from the offshore version. With an offshore Tourist visa, the stay period (3-12 months) is counted from the date of entry.With an onshore Tourist visa, however, the stay is for whatever duration you are granted on the visa itself.


Important reminders for recent Tourist visa applications

1. Parents of permanent residents / citizens

are currently advised against continually extending their Tourist visa onshore in Australia — there is a meaningful risk of refusal and of receiving a warning. It is preferable to depart Australia and wait 3-6 months offshore before applying for a new Tourist visa to re-enter.For parents who wish to remain in Australia continuously, we recommend the Subclass 870 (Sponsored Parent) visa instead, which can be granted for up to 3 or 5 years at a time.


2. Current processing times for Australian Tourist visas

Under normal processing,most Tourist visas are decided within a month. With a clean background and a complete set of supporting documents, the visa is generally granted without trouble. To be crystal clear: this assumes the documentation is fully prepared.If the applicant has a blank passport or a previous refusal on record, you must make sure you have dug up additional evidence — do not rush to lodge another application(If you would like to know whether a refusal can be overturned, please get in touch with us)


3. If the applicant has a blank passport, a history of refusal, or weaker financial circumstances

you may consider applying under the Sponsored Family stream (sponsored family stream)

The key difference between this stream and a standard Tourist visa is that a sponsor is required

Sponsor requirements:

①The relationship between sponsor and applicant (sponsored person) may be that ofspouse, parent, child, sibling, adoptive parent, step-parent, grandparent, grandchild, or aunt/uncle/niece/nephew(fiancé/fiancée, son-in-law/daughter-in-law and friendship relationships are not eligible to sponsor)

②Must be an Australian citizen or PR who is “settled” in Australia

(generally, having lived in Australia for 2 years after securing permanent residency is consideredsettled”settled”)

-18Aged 18 or above

③If the sponsor has previously sponsored another person and that sponsorship has not yet expired, they cannot sponsor anyone else — unless the previously sponsored person is a family member of the current sponsor

④If the sponsor has previously sponsored someone who breached their visa conditions, the sponsor must wait 5 years after that person’s visa has expired before sponsoring anyone new

⑤The Department of Home Affairs may require the sponsor to lodge a security bond of AUD 5,000 to AUD 15,000 per sponsored person, although in practice this is not common.

Because the sponsor is backing the application, the applicant’s chances of being granted the visa are improved,but the applicant still needs to lodge the usual Tourist visa evidence — employment letters, proof of funds and so on. The visa will also be shorter in duration, single-entry only, and will carry condition 8503 preventing onshore extension.Template-style refusal of a Tourist visa — can it be salvaged? DIY lodgement for parents refused — can you re-apply? Sponsored family / business stream — worth considering?

In short, it is the safer option but comes with more restrictions. For parents of permanent residents or citizens, therefore, unless one of the specific situations mentioned above applies, we do not recommend jumping straight to the Sponsored Family stream.
