Australian Subclass 309 partner visa success story: long-distance same-sex couple approved in 15 months

Key points

How can a long-distance same-sex couple apply for a Subclass 309 partner visa without cohabitation evidence?

A long-distance same-sex couple addressed their lack of cohabitation evidence with extensive international and long-distance travel records, frequent chat records showing emotional support and joint decision-making, evidence of financial interdependence and Form 888 statements from family and friends on both sides.

  • Newstars advises building relationship evidence across all four dimensions: emotional, financial, social and household. None can be left out.

If you are a rainbow same-sex couple too, take a close look at the success story we are sharing today. The clients whose visa was granted are a male couple. Anyone familiar with Australian migration will know that partner visa assessments place considerable emphasis on whether a couple’s relationship is genuine. Their circumstances were quite challenging: they had been in a long-distance relationship for an extended period. Even so, we helped them successfully navigate the process and obtain a Subclass 309 visa!

Today, we will use this case to walk through the timeline and discuss the main challenges that long-distance and same-sex couples face when applying for an Australian partner visa, and how to overcome them.

How did this long-distance same-sex couple overcome the challenges?

The Department of Home Affairs’ central consideration for partner visas is whether the relationship is genuine and continuing. For long-distance couples, the biggest challenge is showing that they remain emotionally together even when physically apart. Same-sex couples also need to prepare certain evidence with greater care.

For same-sex partners, the Department’s legal requirements are much the same as for other partner visa applications, but building the evidence requires meticulous care and rigour. Our clients provided some crucial supporting material:

1/ A US marriage certificate obtained through online registration: recognised by Australia, this was an important document establishing that the couple’s union was legally binding.

2/ Detailed evidence of the long-distance relationship: because the couple lived apart, they had no evidence of cohabitation. We addressed this gap by compiling their extensive international and long-distance travel records, frequent chat records showing emotional support and joint decision-making, evidence of financial interdependence, and statements from family and friends on both sides (Form 888).

3/ A logically structured Love Story: we clearly set out the couple’s relationship timeline and plans for a shared future, allowing the visa officer to readily understand the relationship’s genuine and long-term nature.

Advice for applicants in similar circumstances

Through this case, I want to reassure you: being in a long-distance or same-sex relationship really is no reason to fear applying for an Australian partner visa!

As long as you meet the following points, you too can secure approval smoothly:

Provide comprehensive evidence: piece together evidence across all four dimensions—emotional, financial, social and household. None can be left out.

Make sure the evidence is logically connected: it should form a coherent whole, rather than simply be a pile of documents. Every item must help substantiate your relationship.

Seek professional help for special circumstances: complex situations such as online marriage registration or a long-distance relationship call for a professional migration agent to tailor your document checklist, helping you avoid unnecessary detours and save valuable time. After all, an earlier grant means an earlier reunion!

Whether love spans oceans and mountains or crosses gender boundaries, love and a genuine body of relationship evidence are the best passport.
