Key Point 1: The partner running the business in China applies as the primary applicant for Subclass 188A


– Nominated by the South Australian state government

– Ownership or shares in a business with an annual turnover exceeding AUD 750,000

– Personal and business assets of at least AUD 1,250,000

– Points test score of at least 65

– Aged under 55 (applicants over 55 may still apply if they can demonstrate exceptional contributions)

Key Point 2: The accompanying parent in Australia applies as the secondary applicant for Subclass 188A

[Case Study]

Ms W arrived in Australia in 2017 on a Subclass 590 visa to accompany her child’s studies. In 2018, with our assistance, she submitted an application to the Department of Home Affairs and successfully obtained a waiver of condition 8534 — enabling her to lodge a Subclass 188A visa application onshore without departing Australia. The visa was subsequently approved. (The approval email for the waiver is shown below.)


Key Point 3: Once Subclass 188A is granted, the secondary applicant (the accompanying parent) can convert to become the primary applicant for Subclass 888A — primary and secondary applicant roles can be swapped when transitioning to 888A


The ability to swap primary and secondary applicants is one of the most distinctive features of the Subclass 888 visa.The spouse or de facto partner of a Subclass 188A visa holder can convert to become the primary applicant for a Subclass 888 permanent residency visa, taking on responsibility for managing the business and meeting the residence requirements in Australia.In a meaningful way, this swap reduces the difficulty of transitioning from Subclass 188 to Subclass 888, enabling both partners to divide responsibilities between China and Australia.

[Case Study]

In 2018, a client and his family entered Australia on Subclass 188A visas with the support of our professional team. The family ultimately obtained the Subclass 888 visa, with Ms Z as the primary applicant.
