The Migration Institute of Australia (MIA, which primarily represents registered migration agents in communications with the Department) notified the industry last week that while the legislation has not yet been finalised in detail,they expect that from 1 July of the 2022–23 financial year, applications for the Subclass 485 Graduate Work visa will not require a skills assessment and can proceed smoothly,and they will continue to follow up with further updates.

It is now late May, yet we can already see hints of some of the application conditions for the 485 Graduate Work visa incertain official documentsreleased to date.

The Queensland Government website states that it has received notification from the Department that ‘in the 2022–23 financial year, the Subclass 485 Graduate Work (old TR) will temporarily remove the requirement to nominate an MLTSSL occupation’.‘This means that if a client has studied any Diploma or Advanced Diploma and completed at least 92 weeks of study, and graduates before the end of June 2023, they will have the opportunity to apply for a two-year Subclass 485 Graduate Work visa.’

At the same time, the Australian Department of Education, Skills and Employment released an updated International Education Strategy 2021–2030 as early as 7 December 2021,explicitly stating that ‘in the 2022–23 financial year, the requirements for a skills pre-assessment and occupation nomination will be temporarily removed, giving more applicants the opportunity to apply for the Subclass 485 Graduate Work visa’However, that document did not go as far as the Queensland Government website in hinting at what qualification the applicant would need to hold.

*The following is the author’s own analysis. The specific official details may differ, and this article is intended to give TAFE and vocational graduates some ideas on how to prepare in advance.
Estimated: What conditions will be required to apply for a 2-year Subclass 485 Graduate Work visa? .
Firstly, under the current Subclass 485 Graduate Work requirements,applicants must hold two years of CRICOS-registered studyandhave completed at least oneCert III or higher trade course / Diploma / Advanced Diploma / Degree, and the studymust be closely related to the nominated occupation.
Based on the official documents referenced above, the most likely course combination at this stage is that applicants will need two years of CRICOS-registered study and have completed at least one Cert III or higher trade course / Diploma / Advanced Diploma / Degree.
So, to take advantage of this possible 2022–23 financial year policy update, applicants may wish to consider the following:
1. Check your completedcourse CRICOS weeksand if you do not meet the requirement, plan to study additional courses to make up the 92 weeks.
2. Check yourcompleted course types, and if you have not completed any of the above qualifications,plan to study additional courses to obtain at least one Cert III or higher trade course / Diploma / Advanced Diploma / Degree.
3. Plan your schedule to ensure you can graduate and submit your Subclass 485 application before the end of the 2022–23 financial year.
The benefit of doing so is that in addition to being granted a two-year Subclass 485 visa, you will have a better opportunity to use those two years to complete a skills assessment and prepare for your future skilled migration pathway.

A reminder for those preparing to apply for the 485 Graduate Work visa
At the same time, the author would like to remind those planning to apply for this type of Subclass 485 visa to pay close attention to the following:
—Applicants with credit transfers —whether they still satisfy the 92-week CRICOS week study requirement
—whether they held an Australian visa throughout their period of study,and when did their last student visa expire?
—The stream of the application —do not get it wrong.

In addition,the Subclass 485 Replacement stream is also expected to be available for lodgement around mid-2022, which is something many applicants are eagerly awaiting.
More application details are likely to emerge in the near future. The requirements published by the Department so far include:
– Currently holding a Subclass 485 visa, or a Subclass 485 visa that expired on or after 1 February 2020
– Was outside Australia at any point between 1 February 2020 and 15 December 2021
The validity period of this replacement visa will be the same length as the original Subclass 485 held,the primary applicant’s application fee is AUD 1,680,spouses included on the original Subclass 485 can apply for the replacement together,at the same cost and for the same duration as the primary applicant. That is all the information currently available — the Department is still working through further details and an update is expected before long.
