【485 Replacement Stream Legislation Confirmed】Onshore & Offshore Applications and Grants Now Open! Who Among Old 485 TR Holders Can Skip Skills Assessment?

Just now, 485 replacement streamthe legislative details have been released!

Clarification 1:Applications can be submitted from 1 July 2022, and will continue to be accepted until 1 January 2027!

Clarification 2:Applications may be lodged and visas granted onshore or offshore

[subitem (5)]

Clarification 3:Requirements for holding a 485 (broadly consistent with what was previously published on the official website)

Regardless of whether you were onshore or offshore when your first Subclass 485 was granted — if you lost visa time between 1 February 2020 and 14 December 2021 due to departure (that is, you left Australia and border closures delayed your return) — and regardless of whether you are currently onshore or offshore, you are eligible to apply for the replacement, and the grant length will match the length of your original Subclass 485.

For example, the new coursework master’s Subclass 485 is now 3 years, but the previous grant was 2 years —if you previously graduated with a master’s degree and received a 2-year Subclass 485, the replacement will be for 2 years, not 3 years.

Clarification 4:Regional graduates retain eligibility to extend by 1 or 2 years

If you graduated from a regional institution, continued to live and work locally during the Subclass 485 Replacement period, and subsequently remained eligible to extend by 1 or 2 years — that entitlement is preserved(the specific extension period depends on the regional classification: for example, the whole of Tasmania or Canberra may extend by 1 year, while the whole of the Northern Territory may extend by 2 years)

Old 485 TR

In addition, regarding last Friday’s article on the removal of the skills assessment requirement for old Subclass 485 TR holders, many of you have followed up with detailed questions — here is some additional clarification for everyone:

Key policy points:The valid application window is 1 July 2022 – 30 June 2023, meaning applicants who meet the requirements within this period can lodge a Graduate Work Stream Subclass 485 visa.

Who this policy applies to:

The core of this policy is the removal of the requirement for old 485 TR holders to have an occupation on the long-term skilled occupation list and a positive skills assessment, but this does not mean that all graduates of all programmes qualify under this new policy. The core requirement is: applicants must still meet the Australia Study Requirement.

Although most applicants will be able to satisfy this requirement, the following groups should take note:

Standard Certificate III and Certificate IV,non-tradecoursesare not eligible;trades such as commercial cookery, automotive, welding, and aged careareeligibleto apply(please contact us for an assessment of your specific programme);

Graduate Certificate coursesgraduatesare also not eligible

translation programmes — Diploma of Interpreting (NAATI Level 2) is not eligible;Diploma of Translation (NAATI Level 3) is eligible

This policy is currently focused on students who have recently graduated or are due to graduate within the coming year, in order to address immediate skilled labour shortages. Eligible students are strongly encouraged to meet the English language requirements as a priority.
