Victoria Opens New Financial Year State Nomination — More Occupations Eligible! Tasmania Updates Provisional Quotas, Subclass 190 Nearly Doubles!


Victoria has announced it is opening state nomination applications for the new financial year, with policy changes relative to the previous financial year!



-Both onshore and offshore applicants may submit applications
-More occupations are now eligible. All occupations on the occupation list will be eligible to apply — STEMM Skills are no longer required, and working in the target sector is sufficient!

Please note that the submission process remains the same as before: you must first submit an EOI application, and after receiving your EOI number, register an ROI. The state government will then issue pre-invitations based on applications. Once a pre-invitation is received, applicants can proceed with the state nomination application. After state nomination is granted, the applicant can apply for the visa.

When submitting the state nomination application:
  • Onshore applicants are required to providean employment contract, payslips from the past four weeks, the most recent superannuation contribution record from the employer, and a position description to declare annual income (if employed).
  • Additionally,Subclass 491 onshore applicants must be living in a regional area of Victoria and have employment relevant to their nominated occupation(this requirement does not apply to Subclass 190).
  • Offshore Subclass 491 applicants are required to submit an ROI for any eligible occupation. Health-related occupations are given priority.
  • For Subclass 190 applications, the nominated occupation can be any occupation eligible for Subclass 190 on the Department’s occupation list, with a skills assessment completed and the minimum points requirement met. Onshore applicants must reside in Victoria.


A few key observations on Victoria’s new policy:
1. Victoria has not yet announced the specific transitional quota, or the breakdown between Subclass 190 and Subclass 491. It is highly likely that the 190 allocation will remain significantly larger than the 491 allocation.
2. For many who were previously unable to apply for Victoria state nomination, the removal of occupation list restrictions is a positive development. However, the actual invitation rates for specific occupations remain to be seen — particularly for Subclass 190, where the prerequisites are essentially the Department’s minimum requirements plus residing in Victoria (for onshore applicants). It is foreseeable that a large volume of applications will be submitted. Of course, the Subclass 190 criteria do specifically mention employment information and income.
Additionally, the ROI invitation rules also reference income considerations, with clearly prioritised occupations:
-Healthcare and social services
-Science, Technology, Engineering and Mathematics (STEM)
-Advanced manufacturing, digital and innovation economy
-Chef, cook, accommodation and hospitality managers – for the 491 visa
-Early childhood, secondary and special education teachers.

It is likely that those who receive invitations onshore will still largely be those with employment related to their nominated occupation. For Subclass 491, onshore applicants are required to reside in and have nominated occupation-related employment in a regional area of Victoria.

Applicants who did not receive an ROI invitation in the previous financial year will need to submit a new application. Victoria has also begun issuing formal EOI invitations for cases that were backlogged from the previous financial year. One of our nursing clients who submitted their application in late June received a formal visa lodgement invitation from the Department today.





Tasmania’s state nomination provisional quota released today


Following the ACT’s announcement of provisional quotas,Tasmania has also released its provisional quotas today — with Subclass 190 nearly doubling!



Subclass 190: 2,000 places (up from 1,100 in the previous financial year)
Subclass 491: 1,350 places (down from 2,200 in the previous financial year)
Tasmania has emphasised that these are transitional quotas, and that the Department will revisit them after the first quarter — please do not assume the current figures represent the full-year allocation. The state government has also indicated it will shortly nominate applications from the previous financial year that remain unprocessed, before opening applications for the new financial year.

New South Wales:The occupation list and application requirements will be announced shortly (applications are not recommended before this financial year’s policy is published). No pre-invitations have been issued this financial year.

ACT (Canberra):The ACT government was the first to announce provisional state nomination quotas. For the 2022–23 financial year, the transitional quota is 800 for Subclass 190 and 1,920 for Subclass 491, totalling 2,720 places.

QueenslandQueensland confirmed its transitional quota on 9 August and is expected to open applications shortly.The main directions announced at a previous information session includedprimarily easing requirements for some locally-trained graduates, opening the work pathway to offshore applicants (onshore applicants remain largely unchanged), and reopening the Subclass 188E for investment migration.The application channel remains closed for now and will not open until the nomination quota is received. Tasmania:Today (11 August), Tasmania announced the 2022–23 financial year provisional quotas — Subclass 190 nearly doubles, while Subclass 491 sees a significant reduction.


Western Australia:The occupation list and application requirements have been confirmed and published, with good news for local graduates! Northern Territory:The MINT programme has confirmed that all migration occupations are eligible to apply, and the newly established MINT graduate pathway has commenced.The general stream occupation list and application requirements have not yet been officially announced.
