On the morning of 19 April, the Tasmanian Government held its scheduled online seminar as planned, mainly covering state-nomination processing speed, remaining quota, invitation rates, invitation-release timing, ROI application tips and more. A recap of the key points follows:

– The number of Priority Attributes required is being gradually lowered, giving less-competitive applicants a chance to be invited

– Faster processing — nomination within a week

– The Employment exclusion clause explained once again

– State officials debunk the rumour: no Release Letter is needed to leave Tasmania

190/491 Quota Usage

Following the good news released by the Tasmanian Government on the morning of 12 April 2023 — “reallocating 150 places from the 491 quota to 190” — state official Martin made it clear at this seminar thatthey will make every effort to issue invitations.

the “Gold” and “Green” applicants in the Working channel / Graduate channel / Long-term Residence channel have now largely been cleared, and while strongly issuing invitations toapplicants holding an Orange Pass, the number of Priority Attributes required is also being progressively relaxed.

With less than two months left in this financial year, can the “less-competitive” applicants who have been patiently waiting in Tasmania still make it across the line this year? Let’s wait and see.

This financial year, the total quotas for 190 and 491 are 2,150 and 2,100 respectively. As at 17 April 2023:

190 quota used: 1,559; remaining quota: 591

491 quota used: 1,509; remaining quota: 591

Processing has currently reached Cases lodged before 5 April 2023

State officials explained in further detail that they currently receive roughly 80-100 ROI submissions each week,and the timing and number of invitations the government releases each week are broadly the same as in March. They also stated clearly that processing will be sped up,and once an applicant is allocated a Case Officer, they undertake to finish processing within one week(more complex Cases excepted).

With quota currently ample and state-nomination processing increasingly showing a “losening” trend, Newstarsec recommends that any applicant who meets the minimum requirements lodge their application immediately and give it their best shot.

Invitation Data Analysis

At this seminar, the State Government also analysed the invitation data. The key figures are as follows:

–After lodging an ROI, the invitation rate is 75%

–In the Graduate channel, 80% of applicants hold an ”Orange Pass”, and applicants whose employment relates to their skills assessment or studies are generally invited

–In the Working channel, a total of 686 invitations were issued to applicants employed in occupations on the TOSOL occupation list, and 585 to applicants employed in occupations not on the TOSOL list or in Anzsco 4-5, accounting for 27% and 5% respectively

–Long-term Residence channel and Business ownersa total of 178 invitations were issued, accounting for 7%

Exclusion Employment Explained Further

If the Business an applicant operates, or their employer’s core business,does not depend entirely on Tasmanian Government policy, and there is sufficient documentation to demonstrate this to the State Government,then the applicant will not be affected by the Exclusion Employment clause.

State Nomination Debunks the Rumour: No Release Letter Needed to Leave Tasmania

State official Martin debunked the claim that leaving Tasmania requires applying to the State Government for a Release Letter. Once an applicant has been granted their visa,if their life or career plans change and they need to leave Tasmania, they do not need to obtain a Release Letter from the government.

However, he hopes applicants will honour their commitment to live and work in Tasmania for two years after their visa is granted; if leaving Tasmania becomes unavoidable, applicants are asked to inform the State Government.

Tips for Small-Business Applicants

Tasmanian small-business applicantsmust be the sole owner or operate the business jointly with their spouse in order to tick the “Business Owner” attribute when applying.If a business has more than two Owners, this cannot be ticked,but the “employment attributes’ attribute can still be ticked as normal.

1. Can an applicant tick both 190 and 491 at the same time?

190 and 491 cannot be ticked at the same time.

Based on the current situation, competition for 190 state nomination is higher than for 491, so applicants who are less competitive are advised to tick 491.

2. An applicant is a Registered Nurse who has worked in the relevant role for three months, but the position is Casual and the hours do not meet 20 hours/week — can they tick Green Pass?

Yes, Green can be ticked. State officials currently focus mainly on the average Working hours when assessing a Case, and will relax the assessment criteria at their discretion.

3. If a 491 nomination has already been obtained, can the applicant lodge a 190 application again as a secondary applicant?

The State Government has previously indicated whether applicants who hold a 491 nomination can be issued a further 190 invitation. If the primary applicant has obtained a 491, they can apply again for a 190 state nomination as a secondary applicant.
