Employer Sponsorship  How to Migrate

Employer-sponsored migration is one of the most commonly mentioned pathways. If you have lived in Australia for a while, you almost certainly know a few people who obtained their green card through employer-sponsored migration.

In short: the TSS (482) visa is a temporary work visa created by the Australian Government to allow Australian businesses to recruit professionals and skilled workers from overseas. It is designed to fill short- to medium-term skills shortages quickly and flexibly, meeting the needs of the labour market.The employer nominates and sponsors the applicant to work for them; once the applicant has completed the required period of work, they can transition to the Subclass 186 Employer Nomination Scheme visa, achieving permanent residency in Australia.

Recent 482  Favourable Policy Changes

On 27 April 2023, the Australian Government announced that by the end of 2023, in addition to occupations already on the medium- and long-term list being able to transition to permanent residency, visa holders whose occupations are on the short-term list will also have a direct pathway to PR. This means more than 200 occupations will newly gain this opportunity!

And there is even more good news to come!

On 5 May 2023, Australia introduced a streamlined Aged Care Industry Labour Agreement to support the aged care sector and ease the current shortage of talent in Australia’s aged care industry.

Soon after, on 15 May, Australia’s first aged care labour agreement under the new arrangements was signed — by Curtin Heritage Living, an aged care provider based in Perth.

Perth’s Curtin Heritage Living signed a five-year MOU with the United Workers’ Union (United Worker’s Union) to employ up to 570 workers.As incentives, Curtin Heritage Living will also receive priority visa processing and the ability to sponsor employees for permanent residency after two years.
Standard employer sponsorship usually requires the applicant to first have work experience related to the nominated occupation, but under the streamlined Aged Care Industry Labour Agreement this is not required; applicants with no relevant work experiencecan instead meet the requirements through their qualifications to satisfy the criteria!

As the above shows, for anyone hoping to migrate, this reform — in terms of both policy and salary levels — presents an excellent opportunity to “overtake on the bend”.

Next, by interpreting the policy, I will walk through, step by step, how to go from “studying” to “permanent residency” — the one-stop “smart play” for obtaining PR in Western Australia.

Studying — “What Should You Study”?

Which fields of study let you enter this “aged care” pathway to PR?

Under the streamlined agreement, the following three occupations are eligible to apply:
Nursing Support Worker (ANZSCO 423312)
Personal Care Assistant (ANZSCO 423313)
Aged or Disabled Carer (ANZSCO 423111)

Once You Have the Qualification, How Do You Apply for the 482?

After completing the relevant programme, how do you obtain a permanent residency visa?
After completing your aged care study programme, you can first apply for the 482, work for your employer for 2 years and meet the other requirements, then transition to the Subclass 186 employer-sponsored Australian PR visa.

Applicant requirements for an “aged care”-related Subclass 482 visa
English requirements:
General aged care providers: IELTS 5.0 (or equivalent), with a minimum of 5.0 in speaking and listening and a minimum of 4.5 in reading and writing.
Culturally and linguistically diverse aged care providers: IELTS 4.5 (or equivalent), with fluency in the target community language.

Skills and qualification requirements:
At least a relevant Australian Qualifications Framework (AQF) Certificate III, an equivalent qualification, or higher,
or 12 months of relevant full-time work experience (equivalent part-time work experience is also accepted).
PS.For onshore Australian qualifications or work experience, a skills assessment is not required first

This is what we mentioned earlier: even without relevant work experience, you can meet the requirements by completing a relevant Certificate III or higher qualification.

Salary requirements (full-time):
The employer must pay the employee an annual salary of no less than AUD 51,222

Age requirements:
No age limit

CHC43015 Certificate IV in Ageing Support
Application fee: $250
Total tuition fees: $5500 ($2750 per semester)
Mode of study: face-to-face, 20 hours per week

– Low English requirements, for applicants with a weaker English foundation who still wish to migrate, this is a great opportunity
– A short study period of just 1 year, and you can also work part-time while studying
– Easy to find work after graduating; once you secure an eligible employer, work and migration can be arranged together

  • What are the challenges?
Visa considerations:
– For applicants already onshore, this pathway is a natural and straightforward fit
If you are currently offshore and wish to apply for a student visa to study an aged care Certificate III or IV, it is becoming more difficult, and each case needs to be assessed on its individual circumstances.
– For offshore qualifications or relevant work experience, a skills assessment must be obtained first.

  • Physical and mental demands:
The work in the aged care industry demands strong physical stamina and good psychological resilience from practitioners

  • Finding an eligible employer:
The employer must meet the requirements of the aged care Labour Agreement to be eligible to sponsor applicants

  • Requirements on applicants when obtaining the green card
– Although the English requirements are very low when applying for the Subclass 482 visa, if you later wish to transition to the Subclass 186 PR visa, you will need to achieve four 6s (PTE accepted);
– Although there is no age limit when applying for the Subclass 482 visa, the age limit for transitioning to the Subclass 186 PR visa is 45. So, if you are around 40, we recommend starting your application as soon as possible!
